By accessing and using our platform designed to track and analyze which appliances are consuming your electricity, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must discontinue use of our service immediately. These terms constitute a legally binding agreement between you and our energy monitoring platform.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breaches.
You acknowledge that the accuracy of energy consumption tracking depends on proper installation, calibration, and maintenance of monitoring equipment. You agree to follow all setup instructions and perform recommended maintenance procedures to ensure optimal performance.
While we strive to provide continuous service availability, we do not guarantee uninterrupted access to our energy monitoring platform. The service may be temporarily unavailable due to maintenance, updates, technical difficulties, or circumstances beyond our reasonable control including internet connectivity issues, power outages, or hardware failures.
Our energy monitoring service provides estimates based on electrical current measurements, appliance signatures, and algorithmic analysis. The accuracy of appliance identification and energy consumption calculations may vary depending on numerous factors including electrical interference, similar appliance signatures, and the complexity of your electrical system. We do not guarantee absolute precision in all measurements or appliance identification.
The service may not be compatible with all electrical systems, appliances, or home configurations. Certain types of electrical installations, including some solar panel systems, battery storage systems, or complex commercial setups, may require additional equipment or may not be fully supported.
All content, features, functionality, software, algorithms, user interfaces, graphics, designs, and data presentation methods available through our energy monitoring service are owned exclusively by us or our licensors. This includes but is not limited to proprietary appliance recognition algorithms, energy analysis methodologies, and data visualization techniques.
You retain ownership of your energy consumption data. However, by using our service, you grant us a worldwide, non-exclusive, royalty-free license to use, analyze, and aggregate your anonymized data for service improvement, research, and development purposes. We may use anonymized, aggregated data to develop insights about energy consumption patterns, improve appliance recognition accuracy, and create industry benchmarks.
You may not copy, modify, distribute, sell, lease, or create derivative works based on our service or any portion thereof without explicit written permission. The unauthorized reproduction of our appliance detection algorithms, energy analysis methods, or software components constitutes intellectual property infringement.
All trademarks, service marks, logos, and trade names displayed on our platform are our registered or unregistered trademarks or those of our partners. Nothing in these terms grants you any right to use such trademarks without prior written authorization.
Our energy monitoring service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that the service will meet your specific requirements or that operation will be uninterrupted or error-free.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. This includes but is not limited to damages for loss of profits, data loss, utility bill increases, equipment damage, or business interruption, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims related to the service shall not exceed the amount you paid us for the service during the twelve months preceding the claim, or one hundred dollars, whichever is greater.
We are not responsible for any electrical hazards, fires, equipment damage, or personal injury resulting from improper installation, use, or maintenance of monitoring equipment. You assume all risks associated with electrical installations and modifications. We strongly recommend consulting qualified electricians for all installation procedures.
We are not liable for actions, errors, or omissions of third-party service providers, utility companies, equipment manufacturers, or internet service providers that may affect your use of our energy monitoring service.
We reserve the right to modify these Terms and Conditions at any time. Continued use of the service after changes constitutes acceptance of modified terms. We may suspend or terminate your access to the service for violation of these terms or for any reason with appropriate notice. Upon termination, your right to use the service ceases immediately, though certain provisions including intellectual property rights and liability limitations shall survive termination.
